The Financial Conduct Authority (FCA) Test Case Judgment was published on 15 September 2020, stating that losses arising from closure of businesses due to the Government’s action in response to the COVID-19 pandemic are not covered by Ecclesiastical’s BI policies and therefore we are not required to pay claims on those policies. The FCA confirmed on 2 October 2020 that it did not intend to Appeal the High Court’s ruling in respect of Ecclesiastical’s policies. We are very mindful that this is an unprecedented situation that has been tough for customers and we now hope the Judgment provides the certainty and clarity that the Test Case was designed to create.
